行政手段是艺术作品法律保护中的一种重要类型,是对司法保护的有益补充,本文将从知识产权行政保护的定义出发,重点考察其对云南省艺术作品保护的现实意义。本文注重法律文本中对艺术作品知识产权保护制度执法依据的列举,总结云南省地州实践操作的运用和地方性立法的经验总结,提出了行政保护的具体对策。
Administrative means is an important type in the legal protection of works of art and is a useful complement to judicial protection. This article will proceed from the definition of administrative protection of intellectual property and focus on its practical significance for the protection of artistic works in Yunnan Province. This article pays attention to the enumeration of law enforcement basis of legal protection of intellectual property in legal texts, summarizes the practice of prefectures and states and the experience of local legislation in Yunnan Province, and puts forward the concrete countermeasures of administrative protection.
