近年来,各地因非法制造、买卖、运输、储存烟花爆竹而发生的涉爆犯罪呈高发频发态势。以广西灵山县为例,2008年至2010年,在制造烟花爆竹中就发生了9起严重的爆炸事故,造成30多人伤亡。而由于对涉及烟花爆竹的法律法规存在不同的解读,司法实践常常在定罪上产生分歧,对打击非法制造、买卖、运输、储存烟花爆竹等违法犯罪行为带来一定的影响。因此,潘雪红代表近年来多次建议修改完善涉爆犯罪法律条文及司法解释。
