案情简介:王某等16人系某企业职工,1995年7月1日,企业与他们签订了为期4年的劳动合同,合同到期后,双方没有续签劳动合同,但形成了事实上的劳动关系。2001年1月30日,企业以“违犯劳动纪律、无故不上班等情况”为由,行文终止了与王某等16人的劳动合同,并将该文件报送企业主管部门和劳动部门,但没有将文件送达给职工本人。2003年3月17日,王某等16人以企业终止他们劳动合同的依据不符合客观事实,且终止合同程序违法,联名向某县劳动争议仲裁委员会提起申诉,要求:撤销企业的终止文件,支付工资并加付25%的赔偿金,依法给他们上缴养老保险费。
