社会管理创新是党和国家审时度势提出的一项战略性举措,意义重大。自2004年起,我国各级各类国家机关纷纷进行社会管理创新,公安机关在社会管理创新中扮演着重要的角色,取得了显著成就。社会管理创新行为是国家机关的一种职权行为,必须接受法治的引领。法治引领社会管理创新行为具有必然性,不能以制定法的局限性和民意为由突破法律进行社会管理创新。社会管理创新必须依法进行,创新的行为权限、管理体制机制、管理办法的创新应当合法并遵循正当程序。法治对社会管理创新具有重要的保障作用,可使社会管理创新正当化、排除妨碍和干扰、巩固创新成果、建构社会管理创新法律制度体系。
Social management innovation is a strategic move put forward by the party and the state in assessing the current situation and is of great significance. Since 2004, various kinds of state organs at various levels in China have conducted social management innovations one after another, and public security organs have played an important role in social management innovation and have made remarkable achievements. Social management innovation is an act of state authority and must be guided by the rule of law. The rule of law leads the inevitable social management innovation. We can not make breakthroughs in the law to carry out social management innovation based on the limitations of lawmaking and public opinion. Social management innovation must be carried out in accordance with the law. Innovative behavioral authorities, management of institutional mechanisms, and innovations in management practices should be legal and follow due process. The rule of law plays an important safeguard role in social management innovation, which can legitimize social management innovation, eliminate interference and interference, consolidate the achievements in innovation, and construct a legal system of social management innovation.
