犯罪被害人问题是伴随着犯罪问题而存在的一个严重社会问题。然而它却是一个被社会忽视的社会问题。在犯罪被害人因犯罪而遭受严重损害而又无法通过其他方式获得损害赔偿的情况下,国家应当对犯罪被害人进行补偿,这不但是当前世界各国的潮流和发展趋势,也有其理论根据。在我国建立犯罪被害人国家补偿制度不但有其必要性,而且现阶段也具有可行性。另外,本文借鉴国外的做法,结合我国实际,提出了我国建立被害人补偿制度的制度构想。
The crime victim problem is a serious social problem that accompanies crime. However, it is a social issue that is neglected by society. In the event that a criminal victim has suffered serious damage due to crime and can not be compensated for damages by other means, the state should compensate the victims of crime. This is not only the trend and trend of development in the world but also its theoretical basis. It is not only necessary to establish a national compensation system for victims of crime in our country, but also feasible at this stage. In addition, this article draws lessons from the foreign practices, combined with the reality of our country, put forward the system conception of establishing the victim compensation system in our country.
