案情2011年10月8日,职业举报人邓某申诉并举报N市G食品分装企业(以下称G企业),诉其生产(分装)的“黄花菜”系未经许可,涉嫌无证生产。N市Y区质监分局就举报部分(申诉部分另行处理)对G企业进行立案调查。调查确认,G企业生产许可证上注明的具体单元及小类名称为:蔬菜制品[食用菌制品(干制食用菌)](分装),产品分类编号为:1601。生产(分装)的“黄花菜”(200克/袋)为50公斤,货值计1080元。N市Y区质监分局在对G企业该行为定性是否为无证生产、是否违法发生了分歧。
