黑社会性质组织犯罪是一种特殊的共同犯罪,其成员长期与公安机关打交道,犯罪心理成熟,有较强的反侦查、反审讯的能力。因此,研究探讨此类案件的特点,选准黑社会性质组织犯罪案件审讯的突破口,有效地制服涉案成员,突破全案,是审讯工作必须解决的重要课题。2001年,黑龙江省大庆市公安局打掉了公安部挂牌督办的以张任行、张国忠为首的黑社会性质犯罪集团,抓获集团成员31名,破获杀人、伤害、金融诈骗、私藏贩卖枪支、走私、寻衅滋事等36起案件,缴获56Ⅱ型冲锋枪、东风三型口径手枪、猎枪、霰弹手枪9支,收缴赃款赃物折合人民币总价值1300余万元。这起大庆司法史上第一例黑社会性质组织案件,现已审理终结,2名组织、领导者和3名骨干成员被判处死刑,其他成员均得到了严惩。此案被评为公安部“打黑除恶”20例精品案例之一,案卷被评为黑龙江省公安厅样板卷。回顾案件侦破过程,笔者认为此案审讯组织得当,突破
Organized criminal syndicate is a special kind of common crime. Its members have been dealing with the public security organ for a long period of time. The criminal psychology is mature and it has strong anti-investigation and anti-interrogation capabilities. Therefore, to study the characteristics of such cases and to select the breakthrough point for the criminal trial of criminal syndicates, effectively subduing the members involved and breaking the whole case is an important issue that must be solved in the trial work.
