经济法作为我国现行法律体系内的一部为正确处理好社会整体利益的法律也是与社会整体利益相关的本位法和基础性法律。其价值就是实现社会整体利益,并据此作为立法依据和立法宗旨。社会整体利益是与国家利益、公民个人利益不同的一种新型利益,是随着社会的发展到一定阶段的产物。正因为如此,笔者从社会整体利益的概念入手,根据社会整体利益在经济法中的地位和维护和保障社会整体利益方法,对经济法与社会整体利益的关系进行分析。
