外商在我国利用BOT投资形式的法律障碍及对策

现行的外商投资企业法律制度不适应BOT投资形式的特殊性 ,由此使BOT投资形式在我国的推行遇到了一些法律障碍。文章分析了这些障碍产生的原因 ,并提出了关于BOT立法的几点建议。

The current legal system of foreign-funded enterprises do not meet the particularity of the BOT investment form, thus making the BOT investment form in our country encountered some legal obstacles. The article analyzes the causes of these obstacles and puts forward some suggestions on BOT legislation.
