《合同法》第286条规定了建设工程款优先受偿权,作为法定抵押权,其时间效力及行使期限对于实际操作有着重大意义。只有在发包人未按约定支付价款,承包人尽了催告义务,并且是适宜折价拍卖的建设工程中才成立优先受偿权。建设工程款应优先受偿于其他抵押权,且该工程款应包括工人工资及材料款。
Article 286 of the Contract Law stipulates that priority should be paid for construction projects. As a legal mortgage, the validity of the time and the term of exercise are of great significance to the actual operation. Only when the Employer fails to pay the price as agreed, the Contractor shall make the obligation of reminding and shall be entitled to a priority claim in the construction project suitable for a discount auction. The construction project should be given priority in repayment of other mortgage rights, and the construction payment should include the wages and materials of workers.
