省域道路交通事故责任确定标准是规范确定当事人道路交通事故责任等具体工作的技术法规,其制定过程涉及的定位、名称使用及细化的主要内容体系等基本理论问题是困扰当前实践工作的难题。通过分析对应执法工作的性质,确定了其在道路交通事故处理执法制度体系中的地方标准属性定位;对比新旧法律规定,给出了“道路交通事故认定”、“责任确定”等基本概念的内涵;确定了“道路交通事故责任确定”的核心名称;分析构建了制定这一技术标准的主要内容体系应当包括:交通事故责任主体及承担交通事故责任首要条件、必备条件、限定条件和定量条件等五个方面。
