公共利益问题已成为我国政府实施反倾销措施时应积极考虑的问题。完善反倾销制度中的公共利益,应以“保护竞争”标准改革倾销行为的判断标准,公共利益的利害关系方应明确包括倾销产品工业用户以及消费者,并建立利害关系方的权利保障机制,引入较少征税原则,细化反规避问题。
The issue of public interest has become a question which our government should take actively into consideration when implementing anti-dumping measures. Improve public interest in the anti-dumping system should be based on the criteria of “competition protection” to reform the judging criteria of dumping. Public interest stakeholders should explicitly include the industrial users and consumers of dumping products and establish the rights protection mechanism of the interested parties, and introduce Less taxing principle, detailed anti-circumvention issues.
