法律在保护网上消费者权益时遭遇了一系列困境,如法律规则的滞后与缺失、责任主体难以确定、举证困难和缺乏有效的法律救济途径等。要想有效地保护网上消费者权益,必须宏观与微观两个层面相结合。宏观上,不仅法律规制与技术支持应双管齐下,而且消费者、商家、政府与国际社会需共同努力;微观上,则必须从完善立法、加强执法与开辟多渠道的司法救济途径三种具体法律措施入手。
Laws have encountered a series of difficulties in protecting the rights and interests of online consumers, such as the lag and lack of legal rules, the difficulty of determining the main body of responsibility, the difficulty of providing evidence and the lack of effective legal remedies. To effectively protect the rights and interests of online consumers, we must combine macro and micro levels. On the macro level, not only should the legal regulation and technical support be implemented in a two-pronged approach, but also consumers, businesses, governments and the international community need to make concerted efforts.
