城镇化是经济社会发展的客观趋势。当前加快城镇化进程对于中国经济结构调整,扩大内需,带动区域协调发展,解决三农问题都具有重要的战略意义。中国一些地方正在探索的农村宅基地置换改革,正是加快城镇化进程的有效途径,但在实践中却面临许多法律瓶颈,亟须给予完善。为此,重点谈了四个问题:一是中国现行农村宅基地制度的弊端;二是中国农村宅基地置换的实践探索;三是农村宅基地置换面临的法律瓶颈;四是农村宅基地置换的立法思路。
Urbanization is an objective trend of economic and social development. At present, accelerating the process of urbanization has an important strategic significance for the adjustment of China’s economic structure, expanding domestic demand, promoting the coordinated development of the region and solving the problems concerning agriculture, countryside and farmers. In some parts of China, the exploration of the replacement of homesteads in rural areas is an effective way to speed up the process of urbanization. However, in practice, it faces many legal bottlenecks and it is imperative to perfect it. Therefore, it focuses on four issues: one is the malpractice of the existing system of rural land sites in China; the other is the practical exploration of the replacement of rural house sites in China; the third is the legal bottleneck facing the replacement of rural house sites; Legislation ideas.
