现阶段我国处于社会主义初级阶段,仍然处于社会转型期,不论是司法与民意之间的复杂关系,还是刑事司法中常识化与专业化的矛盾,在某种程度上都可以由刑法的公众认同去推动,对其矛盾进行有效地缓解作用,可以对其关系实现优化与调整。在落实建设法治社会理念、依法治国的过程中,实现刑法的公众认同,具有较为长远价值与现实意义。
