林地因其具有经济属性、生态属性,因此其产权界定比农地显得要复杂得多,林地的具体权属有学者概括了10个层次的涵义。讨论了林权确权中的非技术因素,认为当地林农对林权的认知(即产权意识)、当地民间风俗的影响、官方规制的不同时期的林改制度变革遗产等因素,对林地的确权具有重要影响。在当前的集体林权改革中,应设计如何在制度变迁的路径依赖中,把各种正式制度和非正式制度包容到村级林改制度实践中,重要的是决策者应当把话语权交给林农自身。
Due to its economic and ecological attributes, the definition of property rights in woodland is much more complicated than that in agricultural land. Some scholars of woodland have summarized the meaning of 10 levels. This paper discusses the non-technical factors in the confirmation of forest rights, considers the local forest farmers’ cognition of forest rights (ie, the awareness of property rights), the influence of local folk customs, and the heritage of forest reform in different periods under official regulation. Confirmation has a significant impact. In the current reform of collective forest rights, we should design how to include all kinds of formal and informal systems in the practice of village-level forest reform in the path dependence of institutional changes. What is important is that decision-makers should give the right to speak Forest farmers themselves.
