在人民代表大会统一行使国家权力的前提下,人民法院依法履行宪法和法律赋予的职责,保障法律的准确实施,是坚持和完善人民代表大会制度的根本要求。坚持和完善人民代表大会制度,必须坚持依法治国基本方略,保障宪法和法律的实施。依法治国是党领导人民治理国家的基本方略,是完善党的领导和实现人民当家作主的基本途径和法制保障。运用法治手段实现党的领导与人民当家作主的统一,是人民法院在推进社会主义民主法制建设中必须做出的努力与贡献。至关重要的是要保证宪法和法律的有效实施。宪法和法律是党的主张和人民意志相统一的体现。
On the premise of the unified exercise of state power by the National People’s Congress, the people’s court fulfills its obligations under the Constitution and laws and guarantees the accurate implementation of the law in accordance with the law, which is the fundamental requirement of adhering to and perfecting the people’s congress system. To uphold and perfect the people’s congress system, we must uphold the basic strategy of governing the country according to law and ensure the implementation of the Constitution and laws. Governing the Country by Law is the Basic Strategy for the Party to Lead the People in Governing the Country and the Basic Way and Legal Guarantee for Perfecting the Party’s Leadership and Realizing People as the Creators. The application of the rule of law to achieve the unification of the Party’s leadership and the people as the masters of the country is the hard work and contribution that the people’s court must make in advancing the building of a socialist democracy and the legal system. It is of crucial importance to ensure the effective implementation of the Constitution and the law. Constitution and law are the embodiment of the unity of the party’s ideas and the will of the people.
