天然橡胶种植引发了严重生态问题,但橡胶种植生态保护法治却存在诸多缺陷,包括防范生态风险立法极不完善,生态监管难以有效实施,生态调控机制严重缺失,毁林种胶责任普遍失究;天然橡胶种植生态保护法治缺陷根本上是由于天然橡胶的法律属性与生态属性的矛盾,如森林属性与生态脆弱性之矛盾,经济林属性与生态效益之矛盾;为此应完善天然橡胶种植的生态保护立法,建立科学、合理的天然橡胶种植保障制度,强化生态监管,健全生态调控机制,加大非法种胶的法律责任。
