《SPS协定》是乌拉圭回合中达成的一项新协定,用于调整动植物及其产品在国际贸易中的检验和检疫问题。本文通过对《SPS协定》出台的背景、主要内容、基本原则及三大核心条款的解析,说明《SPS协定》在保护WTO成员国人类、动植物生命或健康以及维护国际贸易正常开展方面发挥了积极的作用。但是由于《SPS协定》制度本身所存在的缺陷,也给《SPS协定》的实施带来挑战。
The SPS Agreement is a new agreement reached in the Uruguay Round to regulate the inspection and quarantine of animals and plants and their products in international trade. Through the analysis of the background, main contents, basic principles and the three core articles promulgated in the “SPS Agreement”, this article shows that the “SPS Agreement” has played an important role in protecting the life, health and safety of human beings, animals and plants in WTO countries and in safeguarding the normal development of international trade positive effect. However, due to the flaws in the “SPS Agreement” itself, it also posed challenges to the implementation of SPS Agreement.
