根据《服务贸易总协定》金融服务附录,世贸组织成员有权出于审慎原因采取有关措施这种主观主义的审慎监管措施识别在实践中容易产生争议。有关国际组织及一些世贸组织成员正在试图推动世贸组织规定客观主义的审慎监管措施识别标准。这一努力客观上存在许多困难,但它有助于实现《服务贸易总协定》追求的服务贸易逐步自由化目标。我国应该采取包括积极参与有关国际金融监管组织决策过程及加强国内政策协调等应对措施。
According to the Financial Services Appendix of the General Agreement on Trade in Services, WTO members have the right to adopt such subjective and prudent regulatory measures to take relevant measures for reasons of prudence. Identifying is prone to controversy in practice. Relevant international organizations and some members of WTO are trying to promote WTO objective criteria of prudential regulation of regulatory measures. Objectively speaking, this effort has many difficulties, but it helps to achieve the goal of gradual liberalization of trade in services pursued by the General Agreement on Trade in Services. Our country should adopt such measures as actively participating in the decision-making process concerning the international financial regulatory organizations and strengthening the coordination of domestic policies.
