在中国近代史上,民权的保障一直是宪政运动的一个重要方面。本文以《独立评论》中对权利的认识,权利保障的途径、方法、目的的讨论来展现其权利观,重点分析具有自由主义风格的《独立评论》在对待个人自由与社会进步的态度。文章主要以个人自由为中心,展现《独立评论》学人将个人权利与社会进步联系在一起,主张个人权利的实现是社会发展的前提,以适应近代中国在国难时期既要追求民主宪政,又要争取国家强大的现实需要。
In modern Chinese history, the protection of civil rights has always been an important aspect of the constitutional movement. This essay presents the concept of rights based on the understanding of rights, the ways, the aims and the ways of safeguarding rights in Independent Review, and focuses on the attitude of “independent review” with liberal style in treating individual freedom and social progress. The article mainly focuses on individual freedom, showing that “independent review” learners associate individual rights with social progress and advocates that the realization of individual rights is the precondition of social development so as to adapt to the fact that in the period of the national crisis, both China and the United States should not only pursue democratic constitutional government, We must strive for the country’s powerful reality needs.
