金融机构的雇主替代责任与一般雇主替代责任既有相同的地方,又存在着很多不同。不同的地方表现在:主体为金融机构及其雇员、受害者、金融监督管理部门;归责原则一般为无过错原则;侵害客体包含财产权和人格权。在责任承担方面,金融机构与雇员承担的是连带责任。而在金融机构的雇主替代责任的内部承担方面,对于职务密切度高的行为,应规定雇员对发生的损害没有过错而承担了赔偿责任时,可以向金融机构追偿;对于密切度低的行为,适用一般过错的归责原则,此时雇员不得向金融机构追偿。相应地,在金融机构的雇主替代责任中,金融机构也享有双重免责事由。
There are many differences and similarities between the alternative liability of employers in financial institutions and that of alternative employers in general.
