笔者通过反向混淆的历史来源指出了反向混淆的概念和特点,根据目前我国的立法现状和司法实践指出目前我国认定反向混淆的构成要件。针对我国目前的现状,提出笔者认为应该如何认定我国的反向混淆,主要需要四个要件,尤其指出关于原被告双方市场地位的认定和被告的主观意图的了解是反向混淆构成要件的特别之处。
The author points out the concept and characteristics of reverse confusion through the historical sources of reverse confusion. According to the present situation of our country’s legislation and judicial practice, the author points out the constitutional elements of the current reverse confusion in our country. In view of the current situation in our country, I put forward that the author believes that how to determine the reverse confusion in our country mainly requires four elements. In particular, it points out that the understanding of the market position of both the defendants and the accused’s subjective intention is to reverse the confusion of the special elements Department.
