陈水扁案件引起了岛内外民众的广泛关注,然我们对案件的解读不应仅仅停留在政治、民主、文化的层面。整个案件的进程反映了台湾法律的一些符号与原则,活生生的再现了台湾的司法运作机制。作为法学学者,作者认为台湾司法机制中的一些成功的经验与做法对我国大陆正在进行的司法改革是颇有启示的。
The case of Chen Shui-bian has drawn widespread public concern both inside and outside the country. However, our interpretation of the case should not stop at the political, democratic and cultural levels. The whole process of the case reflects some symbols and principles of Taiwan’s law and vividly reproduces Taiwan’s judicial operation mechanism. As a law scholar, the author believes that some successful experiences and practices in Taiwan’s judicial mechanism are quite enlightening on the ongoing judicial reform in mainland China.
