公务员权利救济应当以科学的理论作指导,其法理基础为特别法律关系理论、权利救济理论和行政法治理论。在上述理论的指导下,西方发达国家进行了公务员权利救济的诸多探索,取得了不少成功经验。其中,重视法治、强调公正、注重程序、行政救济与司法救济相结合,尤其值得我们学习和借鉴。
The remedy of civil servants’ rights should be guided by scientific theories. The legal basis of them is the theory of special legal relationship, the theory of right relief and the theory of administrative law. Under the guidance of the above theories, the western developed countries have conducted many explorations of civil servants’ rights relief and have gained a lot of successful experiences. Among them, attaching importance to the rule of law, emphasizing fairness, stressing procedure, combining administrative remedy with judicial remedy, especially worthy of our study and reference.
