刑事一体化思想的提出使刑事法各学科可以在一体化的视野中,提高刑事法的整体理论层次和水平。基于目前学者们基本以刑法学为本位的观点,本文认为各学科应在各自相对独立的情况下,在打击、预防犯罪和保障人权的共同价值理念的指导下,发挥各自的功能和作用,携手共进,联结成相互配合、相互制约、相互促进的并列关系。以此为视角,本文试图对犯罪学的本体理论建设提出自己的看法。
The idea of integrated criminal law makes all subjects of criminal law can improve the overall theoretical level and level of criminal law in the integrated field of vision. Based on the current scholars’ basic viewpoints of criminal jurisprudence, this paper argues that all disciplines should play their respective roles and functions under the guidance of the common values of fighting, preventing crime and safeguarding human rights under their relative independence. Together, join into a coordinated relationship with each other, mutual restraint and mutual promotion. From this perspective, this article attempts to put forward my own views on the construction of ontology theory of criminology.
