所谓遗弃婴儿,指的是负有扶养义务的法律主体遗弃不满一周岁的儿童的行为。根据有关的报道我们发现,在我国遗弃婴儿的行为经常发生,其中女婴和残疾婴儿占多数。这种行为不仅对婴儿的相关权利造成了巨大的侵害,同时也对社会造成了一定的负担和不良影响。从法律的角度来看,虽然我国刑法中没有关于遗弃婴儿罪的单独规定,但是它有可能会构成遗弃罪。所以遗弃婴儿的行为不单单是简单的民事侵权违法行为,更有可能会构成犯罪。本文将从遗弃婴儿的概念、产生原因和危害进行阐述,并提出相应的解决方法。
The so-called abandonment of babies refers to the act of abandoning the law-abiding children of one-year-olds by the legal entities that are obligated to support them. According to relevant reports, we found that the abortion of babies in our country often occurs, of which the majority of baby girls and disabled babies. Such behavior not only caused huge infringement on the baby’s related rights, but also caused a certain burden and negative impact on the society. From a legal point of view, although there is no separate regulation on the crime of abandonment of babies in our country’s criminal law, it may constitute a crime of abandonment. Therefore, the act of abandonment of a baby is not only a simple act of tort but is more likely to constitute a crime. This article will explain the concept, causes and harms of abandoned babies, and put forward corresponding solutions.
