当代国际知识产权保护一体化立法正不断推进的同时,世界各国对于知识产权的保护需求仍然无法达成高度共识。而知识产权法作为冲突规范中一项不可或缺的法律规则,对如何解决涉外知识产权问题具有相当重要的理论与实践意义。本文以涉外知识产权法律适用的基础理论入手,分析了涉外知识产权法在实践中的运用,以期业界同行共同交流探讨。
At the same time that the legislation on the integration of international intellectual property protection is advancing constantly, the countries all over the world still can not reach a high degree of consensus on the protection needs of intellectual property. As an indispensable legal rule in conflict rules, intellectual property law has very important theoretical and practical significance on how to solve the problem of foreign intellectual property. This article starts with the basic theories applicable to foreign intellectual property law and analyzes the application of foreign related intellectual property law in practice so that its counterparts in the industry can exchange ideas and discuss with each other.
