通过判例发展而来的行政均衡原则,是为了适应经济的自由主义发展而产生的,它在解决层出不穷的社会问题上,打破了行政法治原则的局限性,发挥了巨大的作用。近年来,高校学生的法律意识也在不断增强,与学校之间的摩擦,诉至公堂的也不占少数。如何运用行政法均衡原则在高校管理中发挥优势具有很大的现实意义,文章从行政法均衡原则的理论基础分析,通过平等对待原则、禁止过度原则和信赖保护原则三个方面来论述。
The principle of administrative balance, which came from the development of precedents, came into being in order to adapt to the development of economic liberalism. It broke the limitations of the principle of administrative rule of law and played an enormous role in solving the emerging social problems. In recent years, legal awareness of college students is also growing, with the friction between schools, prosecution to court is not a minority. How to use the principle of the balance of administrative law to exert its advantages in the management of colleges and universities is of great practical significance. The article analyzes the theoretical basis of the principle of equal balance of administrative law, discusses the principles of equal treatment, prohibition of excessive principle and principle of trust protection.
