聘用合同属于劳动合同的范畴。有关聘用合同的法律规定,散见在诸多规范性文件之中。如劳动部在1951年5月15日《关于各地招聘职工的暂行规定》,国务院1986年7月12日发布的《国营企业实行劳动合同制暂行规定》(以下简称《劳动合同规定》),国务院1987年7月31日发布的《国家企业劳动争议处理暂行规定》(以下简称《劳动争议处理规定》),国务院1988年6月25日发布的《私营企业暂行条例》(以下简称《私营企业条例》)等都是调整聘用合同的法律依据。聘用合同在签订时当然首先应当符合签订一般合同的条件,但其一旦生效则具有其单独的特点。
