最近几年高校学生状告高校侵犯其权利的案件比重加大,研究高校的侵犯学生权利行为及其应承担的法律责任成为了必要。高校主要侵犯学生的教育权、人身权、财产权、知识产权和法律救济权。侵犯学生权利的高校视情况应承担民事法律责任、行政法律责任和刑事法律责任。教育法律法规对高校的法律责任规定存在缺陷,应予以补充、完善。
In recent years, university students suing colleges and universities violate their rights have increased the proportion of cases, the study of university violations of student rights and its due legal liability has become necessary. Colleges and universities mainly infringe on students’ right to education, personal rights, property rights, intellectual property rights and legal remedies. Colleges and universities that violate the rights of students should bear civil liability, administrative liability and criminal liability as the case may be. Education laws and regulations have defects in the legal liability of colleges and universities and should be supplemented and improved.
