犯罪行为是行为人理性选择的结果。犯罪人的理性贯穿于犯罪人实施犯罪行为的始终,在其犯罪心理中起主导作用。犯罪行为实施的理性基础是犯罪人认识到犯罪比不犯罪更有利。犯罪人的非理性因素虽然存在,但对其决定实施犯罪行为的心理状态起次要作用。
Criminal behavior is the result of the rational choice of the perpetrator. The perpetrator ’s rationality runs through the perpetrator’ s criminal activities and plays a leading role in his criminal psychology. The rationale for criminal behavior is that criminals recognize that crime is more favorable than non-crime. Although the irrational factors of criminals exist, they play a secondary role in the psychological state in which they decide to commit criminal acts.
