生态文明作为一种崭新的文明形式,它以尊重和维护生态环境为宗旨,以可持续发展为根据,是人类文明发展的必然趋势。生态文明是一个系统工程,需要多方面的支撑。其中法治为生态文明建设提供制度保障。而当前我国的环境法律体系中,无论是大的环境立法模式还是小的环境法律保护,都与当前的生态文明理念有所脱节,对于生态文明的促进有一些局限的规定,因此,探讨生态文明理念下如何架构我国的环境法律体系具有重要的意义。

At present, China’s environmental legal system, whether it is a large environmental legislation model or a small environmental law protection, are out of touch with the current concept of ecological civilization. There are some limitations on the promotion of ecological civilization. Therefore, Under the concept of how to structure our environmental law system is of great significance.
