计算机安全取证技术是一项涉及到法学与计算机两门学科的新型学科融合技术,针对这种特殊性质的研究非常有意义。因学科的交互性,不能单独而论,必须将法律和计算机技术相结合进行研究,否则会出现错误的法律认定和技术错乱。文中主要叙述了计算机取证的相关法律问题,重点讨论了如何通过计算机取证,并举例进一步指出现阶段此领域的相关法律层次和技术方面的不足,且讨论了如何健全法律法规,通过计算机规范化工作和取证。
Computer security forensics technology is a new disciplinary integration technology that involves both disciplines of law and computer. It is very meaningful to study this special nature. Because of the interdisciplinarity, we can not treat it alone. We must study the combination of law and computer technology. Otherwise, we will find wrong legal cognizance and technical disorder. The article mainly narrates the relevant legal issues of computer forensics, focuses on how to obtain evidence by computer, and also gives examples to further point out the relevant legal level and technical aspects of this field at this stage, and discusses how to improve laws and regulations, through computer standardization work and Forensics.
