新型城镇化是一个资本、土地和劳动等生产要素重新配置的过程。农民土地权益及其保障关系到城镇化的进程,进而关系到全面建设小康社会的实现。农民不仅是一种职业,更是一种身份,其土地权益不仅包括直接与土地相关的权益,还包括以农村集体经济组织成员权益为基础获得的社会、政治权益等。对农民土地权益的保障要适度,既不能够过高,也不能够太低,否则都不利于新型城镇化进程的推进,农民的土地权益保障和新型城镇化统一于“全面建成小康社会”的目标。在新型城镔化进程中,农民的土地权益主要表现为:农业转移人口市民化中的宅基地、承包地权益、土地征收中的农民土地权益、农村集体经营性建设用地入市交易中的农民土地权益、土地流转过程中的农民土地权益和新农村建设中的农民土地权益。为了更好地实现和保障农民的土地权益,法律制度等需要不断修改和完善。
