我国安全生产事故频发,尤其是天津港“8·12”特别重大火灾爆炸事故发生后,中央对全面加强安全生产工作提出明确要求,扎实落实安全生产责任制,堵塞各类安全漏洞,坚决遏制重特大事故频发势头。检察机关是国家法律监督机关,对加强和保障安全生产工作有着义不容辞的责任,其最主要的参与形式除了诉讼监督,还有制发安全生产类检察建议。本文主要讨论安全生产类检察建议的内涵与功能、存在的问题及完善安全生产类检察建议的建议等方面的思考。
