本文探讨劳动法学的过去和未来。结构如下:第一部分是导论。第二部分研究个别劳动合同的缔结和规制,但主要关注那些使个别劳动合同得以或无法转化为集体谈判的法律。第三部分至第六部分介绍了1960年代以后,主导框架对集体和个别劳动关系的态度受到的来自四方面的扰动:现行立法长期执行不力(第三部分);与学界共识抵牾或超出共识范围的立法行动(第四部分);既存劳动法体制与飞速变化的政经形势不断疏离(第五部分);以及起而反叛的智识运动(第六部分)。第七部分描述了两个在法学界富有生命力的概念:实用主义和自反性。
This article explores the past and future of labor law. The structure is as follows: The first part is an introduction. The second part studies the conclusion and regulation of individual labor contracts, but mainly focuses on those laws that make it impossible or impossible to convert individual labor contracts into collective bargaining. The third part to the sixth part introduce the perturbations in the attitude of the leading framework on collective and individual labor relations after the 1960s from four aspects: the current legislation is not implemented for a long time (Part III); consensus with the academic circles reaches or exceeds the scope of the consensus (Part IV); the existing labor law system is constantly alienated from the rapidly changing political and economic situation (Part V); and the rebel intellectual movement (Part VI). The seventh section describes two concepts that are viable in jurisprudence: pragmatism and reflexivity.
