外汇行政处罚简易程序作为一般行政处罚程序的补充,具有即时性和高效性的特点,其在外汇检查工作中的运用本具有提高行政处罚效率、丰富监管手段等重要的现实意义,但近年来运用简易处罚处理的案件却呈现弱化态势。本文结合执法实践,对外汇行政处罚简易程序运用现状和存在的问题进行分析,并对改进行政处罚简易程序在外汇检查工作中的应用提出相应建议。
As a supplement to the general administrative penalty procedure, the summary procedure of foreign exchange administrative punishment has the characteristics of immediateness and high efficiency. Its application in foreign exchange examination work has the important practical significance of improving the efficiency of administrative penalty and enriching regulatory measures. However, in recent years, The cases of summary sanctions have been weakened. Based on the law enforcement practice, this article analyzes the status quo and existing problems of the summary procedure of foreign exchange administrative sanctions, and puts forward corresponding suggestions on how to improve the application of summary procedure of administrative penalties in foreign exchange inspection.
