海运货物提存交付探略

在海上货物运输中,根据提单承运人负有在目的港向收货人交付承运货物的义务。当货物运抵目的港无人提货或收货人拒绝提货时,如何履行交货义务是承运人面临的一大难题。现有法律规定对此救济不足,本文提出将提存制度引入我国海商法领域,以完善我国海事法律相关规定之不足,更好的平衡海上货运关系方的利益,促进我国海上货物运输。

In the carriage of goods by sea, the carrier under the bill of lading is obliged to deliver the goods carried to the consignee at the port of destination. When the goods arrive at the port of destination no one delivery or the consignee refused to pick up, how to fulfill the delivery obligation is a major challenge facing the carrier. The existing law stipulates that this remedy is not enough. This article proposes that the deposit system should be introduced into the field of maritime law in our country so as to perfect the relevant provisions of the maritime law in our country, to better balance the interests of the parties concerned in maritime trucking and promote the carriage of goods by sea in our country.
