宅基地使用权是用益物权的一种,依据我国现行《宪法》《土地管理法》及《物权法》的规定,农村集体经济组织内的农民对其宅基地只享有使用、收益的权能,不能对其进行处分。由于其土地不能进入市场流通变现,阻碍了农村经济的进一步发展。因此,文章立足于当下新农村建设的实际需求,分析当前我国宅基地使用权流转的现状,提出构建符合我国农村实际情况的宅基地使用权流转的法律制度,以促进宅基地使用权流转的顺利进行。
