民事法律不能解决所有纠纷,将民事习惯运用到司法实践中,不但可以弥补民事法律的漏洞,而且可以增强民事法律适应性,有利于民事裁判认可和执行。民事习惯因为内在或外在的原因,导致在司法适用上存在一些问题。通过对民事习惯的整理,确立民事习惯的一般法律渊源地位,再辅之于将其导入司法裁判的程序法规则,将民事习惯合理运用于司法裁判,民事习惯将在解决民事纠纷方面发挥制定法不可替代的作用。
