经过30多年的改革开放,我国在经济上取得举世瞩目的成就,已经成为世界上第二大经济体。毋庸讳言,付出的环境代价也有目共睹。有鉴于此,在发展区域经济时如何避免出现“先污染后治理,再污染再治理”的现象,就成为必须思考的大问题。黄河三角洲作为国家级高效生态经济区,在建设时必须考虑环境保护问题,而环境保护必须有法可依。在立法时需要考量的因素很多,本文认为应从区域立法、处罚方法、公共物品、利益协调、可执行性、社会责任和生态伦理等方面进行考量,以因应科学发展观和绿色GDP的理念。
After more than 30 years of reform and opening up, China has made remarkable achievements in economy and has become the second largest economy in the world. Needless to say, the environmental costs paid are also obvious to all. In view of this, how to avoid the phenomenon of “treating after pollution first and re-pollution again” when developing regional economy has become a big issue that must be considered. As a state-level efficient eco-economic zone, the Yellow River Delta must take environmental protection into consideration when building the environment, and environmental protection must be law-based. There are many factors that need to be considered in the legislation. This paper argues that consideration should be given from the aspects of regional legislation, punitive methods, public goods, interest coordination, enforceability, social responsibility and ecological ethics in order to meet the scientific concept of development and the concept of green GDP.
