一直以来,共同犯罪问题一直是各国司法机关在实践中的难点,因其复杂性给各国司法机关实践带来了难题,犯罪和刑罚的诸多问题都与共犯有密切的联系。在共同犯罪的问题研究中,关于正犯概念的界定往往是研究的重点内容,只有明确了正犯的概念,才能正确的把握共同犯罪的界定。
All along, the issue of joint crimes has always been a difficult point in the practice of the judiciary in various countries. Because of its complexity, which has brought difficulties to the practice of the judiciary authorities in various countries, many issues concerning crimes and penalties are closely linked with those who are accomplices. In the study of the problem of joint crime, the definition of the concept of the principal offender is often the key content of the study. Only by clarifying the concept of a true criminal can we correctly define the definition of a common crime.
