平等意为无差别,是人对人的态度,是人类的终极理想之一。自由即由自己做主,不受限制和拘束。人类历史的发展经历过了数万年,但对平等和自由的追求却从未间断过。虽然二者发展至今,平等已经在法律上规定而成为平等权,宪法中也有关于公民的自由权的规定,乍一看二者区别不大,但二者究竟是什么关系?如何更深层次的认识平等权?如何保障实质的平等?这些问题将在本文中加以阐述。
Equality means no difference. It is one’s attitude towards people and one of the ultimate ideals of mankind. Freedom is by itself, unrestrained and bound. Human history has undergone years of development, but the quest for equality and freedom has never ceased. Although the two have been developed so far, equality has been legally stipulated to become equal rights. There are also provisions in the Constitution on the right of citizens to liberty. At first glance, there is not much difference between the two, but what is the relationship between the two and how to deepen their understanding? Equal rights? How to protect the substantive equality? These issues will be described in this article.
