社会治理类检察建议是检察机关法律监督权的一种行使方式。2009年颁布的《人民检察院检察建议工作规定(试行)》昭示着检察建议适用的进一步深入,也毋庸讳言,在促进社会治理方面发挥了积极作用。但目前实践中,社会治理类检察建议在制发方面还存在一些突出问题,需要引起重视并切实加以解决。此外,从长期来看,检察机关的检察建议权将逐步削弱,但对于短期而言,检察建议会随着检察机关社会综合治理政策的强化而进一步深化。
The procuratorial suggestion of social governance is a kind of exercise mode of procuratorial organ’s legal supervisory power. Promulgating the Provisional Procuratorial Work Provisions of the People’s Procuratorate (Provisional) promulgated in 2009 is a clear indication of the further application of the procuratorial proposals. It goes without saying that they have played an active role in promoting social governance. However, at present, there are still some prominent problems in procuratorial work for procuratorial administration of social administration, which need to be given attention to and effectively solved. In addition, in the long run, prosecutorial procuratorial authority will gradually be weakened. However, in the short run, procuratorial proposals will be further deepened with the enhancement of the procuratorate’s comprehensive social management policy.
