在民主意识越来越强,法制建设越来越完善的今天,人民陪审员越来越受到重视,而在审判以外的司法程序中,也有开始出现人民陪审员的足迹。人民陪审员应该扩大其工作半径,这无疑与陪审员制度推进司法民主化的精神相契合,有助于推进和增强司法民主化程度。信访是法院最贴近群众的窗口,又是矛盾聚焦的地方,在“信访不信法”现象越来越严重的今天,人民陪审员参与信访工作显得十分必要。本文将从价值、可行性两方面对该问题进行分析,并结合其他法院先行先试的经验,归纳推进过程中的可能遇到困难,再对症下药提出解决方案。
At a time when the democratic awareness is getting stronger and the legal system is getting more and more perfect, the people’s jurors are getting more and more attention. However, people’s jurors have started to appear in the judicial procedures other than the judiciary. People’s jurors should expand their working radius, which undoubtedly juxtaposes with the spirit of democratization of the judiciary, and helps to promote and enhance the degree of judicial democratization. Petition is the court closest to the masses of the window, but also a focus of contradictions in the “petitions do not believe in law ” more and more serious today, people’s jury members to participate in petition work is very necessary. This article will analyze the issue from both the value and the feasibility, combined with the experience of other courts before the first try to summarize the possible difficulties encountered in the process of advancement, and then put forward the solution to the premedication.
