《中华人民共和国企业破产法(试行)》实施已近20年,此间我国的社会主义市场经济的情形已发生了重大的变化。针对当前我国破产实践中的体制、机制障碍等有关问题,应制定一部体系科学,内容全面,既符合我国国情,又与世界经济接轨的新《破产法》。
The “Law of the People’s Republic of China on Enterprise Bankruptcy (Provisional)” has been implemented for nearly 20 years. During this period, the situation of the socialist market economy in our country has undergone significant changes. In view of the current system of bankruptcy in our country, such as institutional and institutional obstacles, a new “Bankruptcy Law” should be formulated with a scientific system and comprehensive contents that are both in line with China’s actual conditions and with the world economy.
