人的身体的物质表现是肉体,精神表现是灵魂。身体是主体言论行动的承载者。从刑罚产生之日起,它就作用于人的身体。在野蛮时代,刑罚权赤裸裸地实施在肉体上,撕裂它,摧毁它。到了近现代,刑罚权不再残害肉体,而是在保持肉体完整性的基础上,通过规训肉体来改造灵魂。在人道主义者看来,从肉刑到自由刑的转变是一种刑罚的进化,福柯却认为更重要的是权力策略的改变。
