司法权威是指司法机关依照法律规定独立行使司法权,不受行政机关、社会团体和个人干涉的宪法原则得到落实,司法机关和司法制度享有公众信服的力量和威望,司法能够发挥对诉讼的终局作用。具体表现为:司法者信仰法治,侦查权、审判权与监督权相互制约,保证了司法公正;公共权力尊重司法,不会也不能干预司法活动;公众信任司法和司法制度,对司法审理诉讼案件的结果,不在法外寻求干预更不会诉诸非法手段进行对抗。
