《中华人民共和国民法通则》的颁布,是我国法制建设的一个里程碑。自《民法通则》颁布以来,一方面使各级人民法院有了民事审判的基本法律依据,另一方面,对社会生活的许多方面产生了深远影响。医院是公共服务单位,医院与病人之间,医院与社会上其它法人之间的社会关系属于民事法律关系,《民法通则》直接调整这些社会关系。因此《民法通则》的颁布必然对医院的许多管理活动产生影响。作为一个医院管理者,应该充分认识到这种影响的意义,并依法管理医疗活动。本文试图结合医院管理的实际情况浅析《民法通则》对医院管理活动的影响,以期引起医院管理者的重视。
The promulgation of the “General Principles of Civil Law of the People’s Republic of China” is a milestone in China’s legal construction. Since the promulgation of the “General Principles of Civil Law”, on the one hand, people’s courts at various levels have had the basic legal basis for civil trials. On the other hand, they have exerted profound influence on many aspects of social life. The hospital is a public service unit. The social relationship between the hospital and the patient and between the hospital and other legal persons in the community is a civil legal relationship. The General Principles of Civil Law directly regulates these social relations. Therefore, the promulgation of the “General Principles of Civil Law” will inevitably affect many hospital management activities. As a hospital administrator, we should fully recognize the significance of this impact and manage medical activities according to law. This article attempts to analyze the impact of the “General Principles of Civil Law” on hospital management activities in light of the actual situation of hospital management, in order to arouse the attention of hospital administrators.
